Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and CampingPH Technologies Inc. ("Camping PH," "we," "us," or "our"), governing your access to and use of the Camping PH platform, including our website, mobile applications, and related services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you may not use the Platform.

1. The Platform

Camping PH operates an online marketplace that enables campsite owners and managers ("Hosts") to list, offer, and manage camping accommodations and experiences, and enables users ("Guests") to search for, discover, and book such accommodations. Camping PH is not a campsite operator, travel agency, or insurer. We act solely as an intermediary platform facilitating transactions between Hosts and Guests.

When Hosts and Guests enter into a booking, they enter into a contract directly with each other. Camping PH is not a party to the contract between Host and Guest and shall not be liable for any acts, errors, omissions, representations, warranties, or negligence of any Host or Guest.

2. Account Registration

You must be at least eighteen (18) years of age to create an account and use the Platform. By creating an account, you represent and warrant that you meet this age requirement and that the information you provide is accurate, current, and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or use of your account.

3. Host Terms

As a Host on Camping PH, you agree to the following:

  • Listing accuracy: You shall provide accurate, complete, and up-to-date information about your campsite, including location, available amenities, pricing, photos, rules, and any known hazards or limitations. You shall not misrepresent the nature, condition, or features of your campsite.
  • Legal compliance: You shall obtain all necessary permits, licenses, and registrations required under Philippine national and local government laws to operate a campsite, including but not limited to barangay clearance, business permits, and Department of Tourism (DOT) accreditation where applicable. You are solely responsible for compliance with zoning, health, safety, and environmental regulations.
  • Identity verification: You must complete our identity verification process, which includes submitting a valid government-issued ID, before your listings become visible to Guests.
  • Tax obligations: You are solely responsible for determining and fulfilling your tax obligations, including income tax, value-added tax (VAT) or percentage tax, and local business taxes, as applicable under Philippine tax law. Camping PH does not provide tax advice.
  • Guest safety: You shall maintain your campsite in a safe and habitable condition and shall promptly address any hazardous conditions. You are responsible for providing adequate safety information to Guests, including emergency procedures and the location of the nearest medical facility.
  • Honoring bookings: You agree to honor confirmed bookings. Host-initiated cancellations may result in penalties, including reduced search visibility, calendar blocking, and, in cases of repeated violations, account suspension.

4. Guest Terms

As a Guest on Camping PH, you agree to the following:

  • Respectful use: You shall use campsites responsibly, treat them with care, and comply with all campsite rules established by the Host. You are responsible for any damage caused by you or members of your party during your stay.
  • Accurate booking information: You shall provide accurate information when making a booking, including the number of guests, any special requirements, and valid contact details.
  • Leave No Trace: You shall practice responsible outdoor ethics, remove all trash and personal belongings upon departure, and leave the campsite in the condition you found it.
  • Assumption of risk: Camping and outdoor activities involve inherent risks, including but not limited to adverse weather, wildlife encounters, rough terrain, and limited access to medical care. You acknowledge and accept these risks and agree that Camping PH shall not be liable for any injury, loss, or damage arising from your participation in outdoor activities.
  • Reviews: You are encouraged to leave honest and fair reviews. Reviews must not contain defamatory, threatening, discriminatory, or otherwise objectionable content. We reserve the right to remove reviews that violate these standards.

5. Payment Terms

Guest payments: When you book a campsite, you authorize Camping PH to charge the total booking amount (including the base rate, service fees, and any applicable taxes) to your selected payment method. Payments may be made via GCash, Maya, bank transfer, or credit/debit card. Payment is collected at the time of booking confirmation.

Service fee: Camping PH charges a commission of 10% of the booking subtotal, which is deducted from the Host payout. The service fee covers platform access, payment processing, customer support, and platform maintenance. The applicable fee is displayed before you confirm a booking.

Host payouts: Host payouts are processed within twenty-four (24) hours after the Guest's scheduled check-in date, minus the Camping PH service fee. Payouts are disbursed to the Host's designated GCash, Maya, or bank account. Camping PH is not liable for delays caused by third-party payment processors or banking institutions.

Currency: All prices and payments on the Platform are denominated in Philippine Pesos (PHP).

6. Cancellation and Refund Policy

Each campsite listing specifies one of three cancellation policies, which are set by the Host:

  • Flexible: Full refund if cancelled at least twenty-four (24) hours before the scheduled check-in time. No refund for cancellations made less than 24 hours before check-in or for no-shows.
  • Moderate: Full refund if cancelled at least five (5) days before the scheduled check-in date. Fifty percent (50%) refund if cancelled between 2 and 5 days before check-in. No refund for cancellations made less than 2 days before check-in or for no-shows.
  • Strict: Fifty percent (50%) refund if cancelled at least fourteen (14) days before the scheduled check-in date. No refund for cancellations made less than 14 days before check-in or for no-shows.

If a Host cancels a confirmed booking, the Guest shall receive a full refund. Camping PH may also, at its discretion, assist affected Guests in finding alternative accommodations.

Force majeure: In the event of extraordinary circumstances beyond the reasonable control of either party — including but not limited to typhoons, volcanic eruptions, earthquakes, floods, government-imposed travel restrictions, or public health emergencies — Camping PH may, at its sole discretion, override the applicable cancellation policy and issue full or partial refunds.

7. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable Philippine or international law.
  • Create listings for properties you do not own or have authorization to manage.
  • Circumvent the Platform's payment system by arranging direct payments with other users to avoid service fees.
  • Post false, misleading, or deceptive content.
  • Harass, threaten, discriminate against, or harm other users.
  • Scrape, harvest, or collect user data from the Platform without authorization.
  • Upload viruses, malware, or other harmful code.
  • Impersonate another person or entity.
  • Use automated tools (bots, scripts) to access or interact with the Platform without our prior written consent.

8. Intellectual Property

The Platform and its original content (excluding user-generated content), features, and functionality are owned by CampingPH Technologies Inc. and are protected by Philippine intellectual property laws, including the Intellectual Property Code (RA 8293).

By posting content on the Platform (e.g., photos, reviews, listing descriptions), you grant Camping PH a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, modify, and distribute such content in connection with the operation and promotion of the Platform.

9. Limitation of Liability

To the maximum extent permitted by Philippine law, Camping PH, its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform, including but not limited to:

  • Personal injury or property damage arising from campsite stays.
  • Loss of revenue, profits, or data.
  • Service interruptions, errors, or security breaches.
  • The conduct of any Host or Guest, whether online or offline.
  • Any content posted by users of the Platform.

Our aggregate liability for any claims arising from or related to these Terms or the Platform shall not exceed the greater of (a) the total service fees paid by you to Camping PH in the twelve (12) months preceding the claim, or (b) Five Thousand Philippine Pesos (PHP 5,000.00).

10. Indemnification

You agree to indemnify, defend, and hold harmless Camping PH and its directors, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of or related to: (a) your use of or inability to use the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your violation of the rights of any third party.

11. Dispute Resolution

Between Users: Camping PH encourages Hosts and Guests to resolve disputes directly through the Platform's messaging system. If a resolution cannot be reached, either party may submit a dispute to Camping PH's Resolution Center. We will review the dispute and, at our discretion, issue a determination which both parties agree to accept as final with respect to any refund or payment adjustment.

Against Camping PH: Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall first be submitted to mediation in accordance with the rules of the Philippine Dispute Resolution Center. If mediation fails, the dispute shall be resolved by binding arbitration under the Alternative Dispute Resolution Act of 2004 (RA 9285), conducted in Metro Manila, Philippines.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of laws principles. Any legal proceedings not subject to arbitration shall be brought exclusively in the courts of Metro Manila, Philippines.

13. Termination

You may terminate your account at any time by contacting us or using the account deletion feature in your settings. We may suspend or terminate your account if we reasonably believe that you have violated these Terms, engaged in fraudulent or illegal activity, or pose a risk to the safety of other users.

Upon termination, your right to use the Platform ceases immediately. Sections of these Terms that by their nature should survive termination — including but not limited to Sections 9, 10, 11, and 12 — shall continue in effect.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform and, for significant changes, by sending a notification to the email address associated with your account at least fifteen (15) days before the changes take effect. Your continued use of the Platform after the effective date constitutes acceptance of the revised Terms.
